- About this Policy and Audientes
- This Privacy Policy describes how and when Audientes A/S collects, uses and shares your personal data when you use the Audientes products, the Audientes app (“App”) and other services offered for sale. If you have any questions or comments about this Privacy Policy, please contact our privacy team at support@audientes.com.
- Audientes A/S is a Danish but internationally operating company (hereinafter “Audientes”, “we”, “or”, “us”), providing hearing aid and hearables products together with the App for smart phones. Our products can be used straight out of the box but can also be used together with our App, which enables you as a user to connect your hearing device to your smartphone via Bluetooth, download the App, and adjust, fine-tune or add new programs thought the App or our website; audientes.com.
- Our address headquarter is located in Denmark as detailed on our website. The company is duly incorporated under the laws of Denmark.
- The privacy policy may be amended from time to time by us with a fair notice.

Data controller
- Audientes is the controller for the personal data collected from the users of our hearing aid products/users of our App.
- We will process your personal data in compliance with European General Data Protection Regulation (“GDPR”) and applicable national law if it provides you with any additional rights.

Purpose and legal basis
- We process your personal data in order to manage your purchase and use of our hearing aid products and other products and we process your personal data in order for us to manage our relationship with you, including managing your account and provide you with access to use our services, support and to advice on the best use of our products. The processing of your personal data is performed on the legal basis of:
- fulfilment of our contractual obligations when delivering our products and supporting services, including our App, to you enabling you to use and control your hearing aid properly.
- We process any health information concerning your loss of hearing you provide us with, when you are using our App (to the extent your loss of hearing can be read out of your settings on the information collected by the App) and any other health information that you provide us with on the legal basis of:
- Your explicit consent/your settings in our App or on your phone or the consent given when using of our support. You may withdraw your consent at any time in your App settings or by sending us an e-mail at support@audientes.com.
- We also process your personal data to deliver and improve our products and services, to let you know about our policies and Terms of Sale and other terms for the use of our services, to manage our business, to improve our offerings, develop new features and updates and new products, develop personalization services and other types of service, including but not limited to develop and implement algorithms and machine learning. This processing is on the basis of:
- Our legitimate interest to improve our platform and services.
- We use your personal information to send you push notifications about new products or marketing messages If you have accepted to receive push notifications in your smartphone settings or in the App settings. If you do not want to receive push notifications from us, just change your settings.
- We also use your personal data to send you e-mails to inform you about new features and products and updates to your hearing aid.
- The processing of personal data when using e-mail or push notifications is performed based on:
- your freely given consent to receive marketing by e-mail and push notifications provided when downloading and installing our App or at a later You may withdraw your consent at any time in your App settings or by sending us and e-mail at support@audientes.com.
- or by clicking the “Unsubscribe” button in any marketing e-mail,
- We use your personal information to send you push notifications about new products or marketing messages If you have accepted to receive push notifications in your smartphone settings or in the App settings. If you do not want to receive push notifications from us, just change your settings.
We do not sell or transfer your personal data to be used for marketing purpose. All marketing based on your personal data collected by us, is processed by us before it is displayed or send out to you.

Categories of personal data
- We mainly collect the personal data that you submit to us, including your contact information and purchase history and your hearing aid setting. We also collect information about to the way you use our hearing aid and technical information about your devices and location.

- When purchasing one of our products online through our own websites and through partner operated websites.
- When buying one of our hearing health solutions, you provide us with certain information as requested by us, currently your name and address and your shipping preferences, an email, your birth year, and your gender and payment information.
- When downloading and installing our App
- When you download and install our App we collect certain information about your smartphone, including the type of device you have, you operating system, certain security settings, your Bluetooth connection, your internet connection and the type of hearing solution you have as specified further below:
- Geo-Location Information.We request access or permission to and track location-based information from your smartphone while you are using our mobile application, to provide location-based services. If you wish to change our access or permissions, you may do so in your device’s settings, but you may lose access to certain services.
- Mobile Device Access.We request access or permission to certain features from your mobile device, including your smartphones Bluetooth connection, microphone and certain sensors. If you wish to change our access or permissions, you may do so in your device’s settings, but the App may not work correctly.
- Mobile Device Data.We automatically collect device information (such as your smartphone device ID, model and manufacturer), operating system, other apps and IP address.

Sharing and Transfer of data
- Personal data about our customers is an essential part of our business. We only share your personal data as described below apart from when we share it with a third-party vendor (including card processing and payment service providers and for transport or insurance purposes) initiated by you.
- We may share personal data regarding you if we are obligated to do so by law, to enforce our Terms of Sale, to protect us against loss or damage. This may include exchanging information with the police, courts, or law enforcement organisations.
- We do not transfer your personal data out of the EU, but you may share or transfer your personal data outside of the EU by using any sharing or transfer functionality that we offer you for your convenience in our App.
- Please accept that if you transfer your hearing aid settings to doctors or other health care professionals, they become the controller and their privacy policy will apply to the processing of your personal data. So please read the recipients privacy policies carefully before you share or transfer your personal data.
- We only transfer anonymized data to our partners and only for research purposes. We may also transfer anonymized data outside of the EU.
- If we sell our business or our company assets are acquired by a third-party, personal data held by us about our users may be one of the transferred assets.
- We and our suppliers (processors) have, as required by the General Data Protection Regulation, implemented appropriate technical and organizational measures to keep your personal data safe. Your rights as a user
- As provided by the GDPR, you have the right to:
- Access personal data regarding you.
You have the right to obtain a copy of the personal data free of charge. However, we may charge a fee corresponding to administrative costs if further copies of the information are requested, or if the request is unfounded or excessive.
- Ask for rectification of incorrect or inaccurate data concerning you, or to have incomplete personal data completed. You can use your access to your account to update your personal data.
- Ask for erasure of personal data regarding you (under certain circumstances).
- Ask for the restriction of the processing of your data (under certain circumstances).
- Object to the processing of your data for marketing purposes by withdrawing your personal consent.
- You can at any time withdraw your consent by sending us an e-mail at privacy@audientes.com.
When we receive a request to access, rectify, or erase, we may ask you for additional information in order to confirm your identity and ensure data security. You can send a request at contact@audientes.com.
- You have the right to complain regarding the processing of personal data concerning you to the competent supervisory authority, which in Denmark is the Danish Data Protection Agency:

Data retention and account deletion
- We store your personal data for as long as you use our App.
- We may also store some of your personal data to comply with our legal obligations.
- You may add or update certain information. When you update information, however, we often maintain a copy of the unrevised information in systems back-ups for a period of time until our backup is updated with the latest version.
- If your use of our App (due to deletion or lack of use) has been inactive for 36 months, we will delete your information. You will receive a notice prior to us deleting your information to allow you to start using the App or retrieve any data from the App that you would like to retrieve.
- When you uninstall our App, we do not delete the data attached to your App, before the above-mentioned period of 36 month has passed. You can always request a deletion by sending us an e-mail at support@audientes.com.
- Please note that some information may remain in our records after your App has been deleted, and that we may only be able to delete this information later when updating our backups.
- Please note that we may hold anonymized data, that at one point originated from you, but as the data is truly anonymized it no longer constitutes personal data and we can keep it for as long as it is relevant to our business purposes.

Security
- You should protect your App in the manner allowed by your mobile phone or as supported by the App.
- All personal information in the App is encrypted when transmitted between your smart phone and our cloud solution (storage).
- We do our best to ensure that your personal data is kept private. However, various instances such as unauthorized entry/use, hardware or software failure, and other factors, may compromise the security of the personal data.
- This Privacy Policy governs information collected when you buy our product at Audientes own operated websites and partner websites and channels, when you use our App or collected though our use of cookies as explained in our cookie policy if you have consented to the collection of other cookies then necessary cookies.

Children's privacy
- If children (naturel persons under the age of eighteen or the legal age in our country of residence) uses our hearing health solutions, we expect that this has been aided by an adult capable of granting consent. If we receive notice or reasonably believe that someone under the appropriate age has provided us with personal information without being allowed to do so, we will promptly delete tall personal information that has been provided to us.

Changes to Privacy Policy
- This Privacy Policy may be amended from time to time. You will be notified before we make changes to this policy with a fair notice, and you will be given the opportunity to review this revised policy before you choose to continue using our App and other services.
- We will use only use personal data in accordance with the privacy policy under which the personal data was collected unless we specifically ask for your consent to process (reuse) your personal data for a new purpose.
